Roy Pearson Loses Another Round

by @ 7:39 am on July 17, 2007. Filed under Dumbasses, Legal

I’d like think that Roy Pearson will finally give up now that his effort to get the judge in his absurd little lawsuit to reconsider her decision has been rejected, but I’m probably wrong:

D.C. Superior Court Judge Judith Bartnoff is not wasting any time letting the pants man, Roy Pearson, know what she thinks of his persistent efforts to have his $54 million lawsuit against the neighborhood dry cleaners turned around in his favor.

Bartnoff decided in an order released late today that Pearson, the D.C. administrative law judge who sued Custom Cleaners because the cleaners allegedly lost a pair of his pants, “has not presented any new argument or authority that warrants reconsideration of the Court’s prior rulings.” So Pearson is back where he was before last week’s 35-page demand for reconsideration of the verdict against him.

In five quick paragraphs, Bartnoff dismisses Pearson’s endless reiterations of his belief that because the cleaners had a sign saying “Satisfaction Guaranteed,” an unhappy customer may demand any resolution he wishes from the merchant. Pearson’s “continued insistence that the ‘Satisfaction Guaranteed’ sign in the defendants’ dry cleaning store is an absolute, unconditional guarantee that the defendants must accede to any customer demand for satisfaction, no matter how unreasonable or even false,” Bartnoff wrote, was already “presented in his pretrial statement, his trial brief, and his arguments at trial.”

Enough already, her latest order seems to say.

Yep, I’m wrong:

Pearson has no intention of halting here. He is expected to appeal Bartnoff’s verdict in a couple of weeks and he will likely also appeal today’s order–all of which only adds to the legal bills faced by the Chung family, the owner of Custom Cleaners.

What complete and utter nonsense.
