Ballot access is controlled by state, not federal law.

To my knowledge, the only state that allows someone to run for two offices at the same time is Texas --- it&#039;s called the LBJ law because it was passed to allow Lyndon Johnson to run for Senate and Veep back in 1960. 

I do not believe Virginia has a similar law.</description>

Warner would almost certainly still win the Senate seat while running for VP.  If he wins both races, then he could take his senate seat in early January and resign a few days later when he is sworn in a VP.  Kaine then would be able to appoint a replacement Dem to fill in for the first two years of Warner&#039;s senate term.</description>

		<description>I think Mark Warner is by far the best option either candidate could choose for VP.  He has the experience as an extremely competent and popular executive governing a predominantly conservative state (not unlike Bill Clinton before he ran).  An Obama/Warner ticket would be the most effective in getting moderates to vote Democratic.</description>

An Albright nomination would tidy things up in the party with Clinton backers, add someone with some solid foreign policy experience, mend any rifts over gender created by the Obama/Clinton dispute, and provide an even more starkly historical choice between McCain and whoever McCain chooses.</description>
