Orly Taitz Reacts To Sanctions Order And Proves That The Sanctions Were Justifed

Orly Taitz’s initial reaction to the $ 20,000 Rule 11 sanction imposed on her by Judge Land of the Middle District of Georgia proves that, if anything, the sanctions imposed were too lenient:

Reached on her cell phone by TPMmuckraker and informed of the $20,000 fine imposed on her by a federal judge this morning, Birther attorney Orly Taitz responded, first, with laughter.

“So he didn’t recuse himself?” Taitz asked, after letting out an extended, nervous-sounding chuckle.

Still defiant after months of legal wrangling and, by our count, three written denunciations by federal district court Judge Clay Land, Taitz said she had absolutely no plans to pay the $20,000 fine.

“Are you kidding? Of course not,” she said, asked whether she planned to send a check. “This is a form of intimidation.”

Instead, she plans to file yet another written response (though it’s unclear whether the court will even accept one).

“I’ll go to the circuit court of appeals. I’ll take this as high as I have to go,” Taitz said.

Now, it is true that Orly, like any other party against whom an adverse final ruling is made, has the right to appeal that case to the relevant Circuit Court of Appeals, in this case it would be the Court of Appeals for the Eleventh Circuit. Given the directness of Judge Land’s ruling, though, it’s clear that any such appeal would be unsuccessful — and, in appealing, Taitz could subject herself to the imposition of additional sanctions for pursuing frivolous arguments before the Court of Appeals.

Asked about the judge’s promise to refer the matter to the U.S. Attorney if she didn’t pay within 30 days, Taitz said she’d have to take a look at the order.

Yea, you might want to do that before talking.

    Was $20K fine enough? Maybe when Taitz becomes a real lawyer she will appreciate what just happened. I wonder if she is a mail order bride, just like her law degree?

    It looks like Judge Land anticipated Orly’s further filings in disregard of his prior rulings and a need for further sanctions. He was awfully carefully to explain and support his decision to hit her with $20,000 and not more, thus leaving more room for deterrence. At some point, one would hope that she finally “gets it”. That she is running her mouth publicly without having read the order perhaps counsels that it may be a good long time and tens of thousands of dollars from now before that happens, however.

    I’m not sure about other jurisdictions, but in California, it is possible to have a party (and presumably, an attorney) declared a “vexatious litigant”. It usually takes several cases prosecuted for improper purposes (or declared frivolous) before such an order can be made. Once that happens, however, the vexatious litigant must obtain leave of court before filing any lawsuit upon a preliminary demonstration that it has merit.

    Anticipating Orly’s likely disbarment and noting her refiling of nearly identical pleadings in different fora, her track record for filing what Judge Land was finally willing to call “frivolous” and getting dismissed in all the others, I can’t help but wonder if vexatious litigant status isn’t somewhere down the road for this shrill and incompetent excuse for a lawyer.

    Something tells me that disbarment alone won’t keep this idiot from filing more of this nonsense simply to stay in the spotlight among adoring idiots.
