Orly Taitz Appeals $ 20,000 Sanction By Federal Judge

Not surprisingly, Orly Taitz has appealed the $ 20,000 sanction entered against her by Judge Clay Land of the Middle District Of Georgia.

And, Orly being Orly, she took a Notice of Appeal, which only needs to contain something approximating the words “I hereby appeal this matter to the Circuit Court of Appeals For The 11th Circuit”, and turns it into a novel that will no doubt lead to another sanctions order:

    I’m so happy she didn’t give up, I was afraid the entertainment would be over. Now we can get more Judges on the Smack-Orly-Down Bandwagon! ;)

    You are correct that the Notice of Appeal needs but a one paragraph statement giving all parties notice of the appeal. It need only include the specific Order she is appealng from, namely the Order resulting from the Rule 11 Sanction.

    As typical, she has apparently failed to even skim the Rules of Appellate Procedure, before going off on another foolish. tirade. It appears she is also attempting to appeal from inferences and statements made in the original Order denying relief which are merely part of the record on appeal and do not need specific reference–they are already part of the record on appeal. It also appears she has no standing (oh no not again) to appeal the previous Orders as she withdrew as counsel.

    Normally, an appellant that only seeks to appeal a portion of the Court’s actions will also file a statement of issues for appeal identifying those limited areas and placing the parties on notice that not all transcripts will be ordered. However, because she appears to be arguing that Judge Land’s Order is completely unsupported she will need to include transcripts relevant to the issue. Of course in her legal mind this means everything in the case.

    Interestingly, she has apparently failed to ask the District Court for a stay of the sanction Order, but did make reference that any attempt would be, in her mind, futile and possibly open her up to even more sanctions. This bald statement may not be enough for the appellate court to consider a motion to stay brought directly on appeal. However, if she does try to bring it directly to the appellate court she will need to provide affidavits supporting her allegations of futility and those ought to be a treat.

    Taitz continues to taint the legal profession with her lack of simple knowledge. She sure is fun to laugh at though.

    Was the $20K fine enough? Maybe when Taitz becomes a real lawyer she will appreciate what just happened. I wonder if she is a mail order bride, just like her law degree? She is perfect reporter material for “Fake News”, where unfounded rumors and innuendo reign supreme , unlike a our US courts of law, where you need to present documented facts, not half baked lies (prepare for more failures).

    When flies get too close to the lights they get burned, Taitz just got burned, thing is, like a fly she will continue, no end in sight. Poor little Birthers they are haters not debaters.

    A lawyer, dentist, realtor and black belt, wow I must say a JACK of all trades master of none.
